Welcome to Ilkem Marble by Ilkem Granite (“Company,” “we,” “our,” or “us”). By accessing or using our website and services, you agree to the following Terms of Service (“Terms”). Please read these Terms carefully. If you do not agree with any part of these Terms, you must not use our services.
1. Acceptance of Terms
By using our services, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws. If you do not agree to these Terms, please do not use our services.
2. Eligibility
You must be at least 18 years old to use our services. By accessing or using our services, you confirm that you are of legal age to form a binding contract with us.
3. Reservations
Scheduling. Users may schedule reservations for services provided by Ilkem Marble by Ilkem Granite at available times, subject to availability.
Cancellations/Modifications by Us. We may cancel or modify reservations if necessary (e.g., system errors, misuse, safety/feasibility concerns). If we cancel a reservation, any amounts you have paid for the affected reservation will be refunded consistent with Section 10.
4. User Responsibilities
When using our services, you agree to:
- Provide accurate and complete information.
- Comply with all applicable laws and regulations.
- Use the services only for legitimate and lawful purposes.
5. Intellectual Property
All content, design, and materials provided on our website and related services, including but not limited to text, graphics, logos, and icons, are the property of Ilkem Marble by Ilkem Granite and are protected by intellectual property laws. You are not permitted to reproduce, distribute, or otherwise use any content without our explicit permission.
6. Limitation of Liability
To the fullest extent permitted by law, Ilkem Marble by Ilkem Granite is not liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the services. Our aggregate liability for direct damages will not exceed the amount you paid for the specific service giving rise to the claim, to the extent permitted by applicable law.
7. Changes to Terms
We may modify these Terms at any time. Any changes will be effective immediately upon posting on our website. Your continued use of our services after changes have been posted constitutes your acceptance of the new Terms.
8. Payment Terms (Consumer Protection)
- Accepted Methods. We accept Personal Checks, Certified Checks, and Credit Cards.
- When Payments Are Due. Payment schedules (including any deposits and final balances) are set forth in your written estimate, proposal, or contract. You agree to pay all amounts when due.
- Taxes & Fees. Prices are exclusive of applicable taxes unless stated otherwise; you are responsible for any taxes required by law.
- Failed/Returned Payments. You are responsible for bank fees arising from returned checks or failed transactions. We may suspend work until any outstanding balances are resolved.
9. Cancellations, Returns & Refunds (Consumer Protection)
- Customer Cancellation Window. You may cancel for any reason within three (3) calendar days after signing the contract. If you cancel within this window, we will refund any deposit or payment received except for (i) non-recoverable costs incurred at your request during the window (e.g., special-order materials already purchased), and (ii) fees disclosed in your contract as non-refundable.
- After 3 Days. After the 3-day window, orders are considered final and non-cancellable, except as required by law or expressly stated in your contract.
- Returns. Custom-fabricated, cut, or installed materials cannot be returned. Installed products are not eligible for return. Unopened, standard-stock accessories may be returnable only if expressly permitted in your contract and in unused, resalable condition.
- Scheduling Changes. Rescheduling is subject to availability. If rescheduling causes additional costs (e.g., re-templating, re-delivery), those costs may be charged where permitted by your contract.
- How to Cancel. To cancel within the 3-day period, you must send a written notice (email is sufficient) to the contact in Section 13 within the deadline. We will confirm receipt in writing.
10. Service Warranty & Disclaimers (Consumer Protection)
- Labor/Workmanship Warranty. We provide a 1-year labor (workmanship) warranty starting from the date of substantial completion/installation. This warranty covers defects in our workmanship and our re-performance or repair (at our election).
- Manufacturer Warranties. Manufacturer warranties apply in addition to our labor warranty and depend on the manufacturer. Terms, durations, and claim procedures vary by manufacturer; we will provide manufacturer information upon request or as included with your product.
- What’s Not Covered. Normal wear and tear; natural variations in stone (including veining, color, porosity); damage from abuse, misuse, impact, chemicals, heat, or improper maintenance; issues arising from site conditions outside our control (e.g., cabinetry, plumbing, structural movement); and third-party work are excluded.
- Remedies & Process. For covered issues, contact us promptly with proof of purchase and photos. Our sole obligation is, at our option, to repair, re-perform, or reasonably replace the affected work.
- Disclaimer. Except for the express warranties above and to the extent permitted by law, we disclaim all other warranties (including implied warranties of merchantability and fitness for a particular purpose). Nothing in these Terms limits any non-waivable consumer rights you may have under applicable law.
11. Dispute Resolution; Governing Law; Venue (Consumer Protection)
- Governing Law. These Terms and any dispute or claim arising out of or related to them or our services are governed by the laws of the Commonwealth of Pennsylvania, without regard to its conflict-of-laws rules.
- Venue & Jurisdiction. You and we agree to the exclusive jurisdiction and venue of the state or federal courts located in Pennsylvania. You consent to personal jurisdiction in those courts.
- Informal Resolution First. Before filing a claim, the parties will make good-faith efforts to resolve the dispute informally within 30 days after written notice of the dispute.
12. Miscellaneous
- Severability. If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force and effect.
- No Waiver. Our failure to enforce any right or provision is not a waiver of such right or provision.
- Entire Agreement. Your signed proposal/contract together with these Terms constitutes the entire agreement regarding the services and supersedes prior discussions on the same subject, except that any consumer rights that cannot be waived by law remain unaffected.
